CONSUMER RIGHTS - RIGHT OF WITHDRAWAL - CANCELLATION AND RETURN CONDITIONS

GENERAL:

  1. By placing an order electronically on the website you are currently using, you are deemed to have accepted the pre-information form and the distance sales contract offered to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) as well as other relevant laws in force regarding the sale and delivery of the products they purchase.

  3. Shipping fees for product delivery will be borne by the buyer.

  4. Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer within a maximum of 30 days. If the product is not delivered within this period, the buyer may terminate the contract.

  5. The purchased product must be delivered in full, conforming to the qualities specified in the order, and accompanied by any warranty certificates, user manuals, and other documents, if any.

  6. If the purchased product becomes impossible to sell, the seller must notify the buyer of this situation in writing within 3 days of learning about it. The total price must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID:

  1. If the buyer does not pay for the purchased product or cancels the payment in the bank records, the seller's obligation to deliver the product will cease.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

  1. If it is determined that the credit card used by the buyer has been fraudulently used by unauthorized persons after the product has been delivered, and if the payment for the sold product is not paid to the seller by the bank or financial institution, the buyer must return the product to the seller within 3 days, with the shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

  1. If force majeure or other unforeseeable reasons prevent the seller from delivering the product on time, the situation will be notified to the buyer. The buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the buyer cancels the order, and the payment was made in cash, the amount will be refunded to them within 14 days of cancellation. If the payment was made by credit card and the order is canceled, the product price will be refunded to the bank within 14 days, but it may take 2-3 weeks for the bank to transfer it to the buyer's account.

BUYER’S RESPONSIBILITY TO CHECK THE PRODUCT:

  1. Before receiving the product/service, the buyer must inspect it; they should not accept goods/services that are damaged, crushed, torn packaging, etc. from the shipping company. The received goods/services will be deemed as undamaged and in proper condition. After delivery, the buyer must carefully protect the product/service. If the right of withdrawal is to be exercised, the product/service should not be used. The invoice must also be returned along with the product.

RIGHT OF WITHDRAWAL:

  1. The buyer may exercise the right of withdrawal without any legal or criminal liability and without providing any justification within 14 (fourteen) days from the delivery date of the product to themselves or the person/organization at the address specified, by notifying the seller through the contact information below.

RIGHT OF WITHDRAWAL PERIOD:

  1. If the purchased product is a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the service has begun with the consumer's consent before the withdrawal period ends.

  2. The costs arising from the use of the right of withdrawal are borne by the seller.

  3. To exercise the right of withdrawal, the buyer must notify the seller in writing through registered mail, fax, or email within the 14-day period, and the product must not have been used as per the provisions set out in the "Products for Which the Right of Withdrawal Cannot Be Used" section of this contract.

USE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice for the product delivered to the buyer or a third party (If the product to be returned is invoiced to a company, it should be returned along with the return invoice issued by the company. Orders invoiced to companies will not be completed unless a return invoice is provided.)

  2. The product to be returned must be delivered in its original box, packaging, and with any standard accessories, if any, in complete and undamaged condition.

RETURN CONDITIONS:

  1. The seller is obligated to return the total price and documents that place the buyer under debt to the buyer within 10 days from receiving the withdrawal notice, and to accept the return of the product within 20 days.

  2. If the value of the product decreases due to the buyer's fault or if it becomes impossible to return the product, the buyer is liable to compensate the seller for the damage in proportion to the fault. However, the buyer is not responsible for changes or deterioration resulting from proper use of the product during the withdrawal period.

  3. If the seller's campaign limit amount is reduced due to the use of the right of withdrawal, the discount amount applied under the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. Products that are prepared according to the buyer's request or for their personal needs and are not suitable for return, such as innerwear, swimwear, makeup products, single-use items, products that can deteriorate quickly or expire, products that, after delivery, are opened and are not suitable for return due to health and hygiene reasons, products that are mixed with other products after delivery and cannot be separated by nature, periodicals such as newspapers and magazines, products immediately provided electronically or intangible products delivered immediately to the consumer, as well as audio or video recordings, books, digital content, software programs, data storage devices, computer consumables, and stationery supplies (toner, cartridge, ribbon, etc.), cannot be returned if their packaging has been opened. Additionally, the right of withdrawal cannot be used for services that have already started with the consumer’s consent before the end of the withdrawal period.

  2. Cosmetics and personal care products, innerwear, swimwear, books, software and programs that can be copied, DVDs, VCDs, CDs, cassettes, and stationery consumables (toner, cartridge, ribbons, etc.) must be unused, unopened, undamaged, and untried in order to be eligible for return.

DEFAULT AND LEGAL CONSEQUENCES

  1. If the buyer falls into default after making the payment via credit card, they accept, declare, and undertake that they will be responsible for the interest payments under the credit card agreement with the bank and the bank may take legal action; the bank may claim the incurred costs and attorney fees from the buyer. In case of default, the buyer agrees to compensate the seller for any damages caused by the delayed payment.
